Divorce Process

Divorce is rarely “one size fits all”, but most cases follow a recognisable sequence. Below is an overview of the key stages, explained in straightforward terms.

Filing Petition

Preparing and filing the petition and supporting documents to start the divorce process (in Hong Kong, you generally must have been married for at least 1 year before you can file).

Serving Petition

Ensuring the petition is formally served on your spouse so the case can move forward properly.

Acknowledgment of Service

Your spouse confirms receipt and indicates whether the divorce is contested.

Decree Nisi & Decree Absolute

Applying for Decree Nisi (a provisional court order) and then Decree Absolute (the final order) after the relevant waiting period (often no earlier than 6 weeks after Decree Nisi).

Ancillary Relief (Finances)
